According to a public notice issued by the Solicitors Regulation Authority (SRA), and as highlighted in The Law Gazette recently – 9th June 2023 – a solicitor has been penalised with an £18,750 fine for permitting a client account shortage and accepting £10,000 from an elderly client. A penalty issued at this level follows the SRA’s new fining powers, which are now in force.
The solicitor, who is also the manager and owner of a firm based in Kent, was found to have allowed the withdrawal of client money from a client account, resulting in a deficit of £17,819.16. In addition to this breach, he also accepted a £10,000 payment from an elderly client who may have been particularly vulnerable. It was also found that he did not fulfil his duties as the compliance officer for finance and administration.
In issuing the penalty, the SRA said, ‘a penalty at this level would act as a credible deterrent to Mr Hawkridge and to others.’ He was also required to pay costs of £1,350.
